1. Introduction
OneTake Collective LLC ("OneTake," "we," "us") operates the OneTake platform, which connects content creators with brands for user-generated content campaigns. This Privacy Policy explains how we collect, use, store, share, and protect your personal information when you use our website and services, and the choices and rights you have. It applies to creators, applicants, event sign-ups, and visitors. By using the Platform, you agree to this Policy.
2. Information We Collect
Information you provide:
- Account information: Name, email address, password, phone number, date of birth or age range, gender (optional), city and state
- Creator profile: Social media handles and follower counts (Instagram, TikTok, YouTube), content style preferences and categories, portfolio links, bio, profile photo, turnaround time, availability, rates, and sales/GMV ranges you report
- Shipping information: Mailing address for product shipments
- Payment information: Your preferred payout method and the details needed to pay you (e.g., PayPal or Venmo handle, deposit details), plus tax forms (e.g., W-9) where required
- Age confirmations: Confirmations that you meet age requirements (e.g., 21+ for regulated-product campaigns)
- Content: Photos, videos, and other content you submit through campaigns
- Communications: Messages sent through our in-app messaging system, chat widget conversations, email replies, and SMS replies (including opt-out requests)
- Event sign-ups: Information submitted at booths or events through our sign-up forms, including the event source code
Information collected automatically:
- Usage data: Pages visited, features used, actions taken on the Platform
- Device information: Browser type, operating system, screen resolution
- Log data: IP address, access times, referring URLs
- Link & message analytics: When you click a tracked link we send by SMS or email, we record the click with your IP address, browser user-agent, referrer, and an identifier tying it to the message — including automated bot-detection — to measure campaign performance
- Cookies & local storage: Session cookies for authentication and preferences, and local storage used for chat-session continuity and to queue event sign-ups offline (see Section 8)
3. How We Use Your Information
- Provide the service: Create and manage your account, match you with campaigns, review submissions, process payments, and ship products
- Communications: Send campaign updates, application decisions, shipment and payment notifications, deadline reminders, welcome emails, and — with your consent — marketing emails and text messages such as campaign invitations
- Campaign matching: Share relevant profile information (name, social handles, content styles, audience metrics, location) with brands for campaign matching purposes
- AI features: Provide AI-assisted chat support on our website and generate campaign briefs; chat conversations are processed by our AI provider and stored so we can follow up and improve support (see Section 7)
- Analytics: Measure message delivery, opens, and link clicks; analyze usage patterns to improve features and user experience
- Safety and compliance: Verify eligibility (including age requirements), detect fraud and fake engagement, enforce our Terms of Service, and comply with legal obligations (including tax reporting)
- Sales verification: Cross-reference sales and GMV figures you report to us against actual sales data from commerce platforms we have authorized access to (for example, TikTok Shop seller or affiliate reporting) to keep creator performance data accurate
4. Information Sharing
We do not sell your personal information, and we do not share it with third parties for cross-context behavioral advertising. We share information only with:
- Brands/advertisers: Your creator profile (name, social handles, content portfolio, audience metrics, location) is shared with brands when you apply to or are matched with campaigns. Brands do not receive your email, phone number, password, payment details, or shipping address unless required for campaign fulfillment.
- Service providers (processors): Vendors who help us operate the Platform and are bound by confidentiality and data-protection obligations — including cloud hosting and database services, SMS delivery carriers and providers, transactional email providers, payment processors, AI model providers (for chat and brief generation), address-autocomplete services, and shipping/fulfillment partners.
- Legal requirements: When required by law, subpoena, or legal process, or to protect our rights, enforce our agreements, or protect the safety of our users and the public.
- Business transfers: In connection with a merger, acquisition, financing, or sale of assets, your information may be transferred to the acquiring entity, subject to this Policy.
5. Text Messaging (SMS)
- By providing your mobile number during signup, you consent to receive text messages from OneTake, including account/transactional messages and, where you have agreed, marketing and campaign-invite messages.
- Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
- Reply STOP (or UNSUBSCRIBE, CANCEL, END, QUIT) at any time to opt out of texts; you will receive a one-time confirmation message. Reply HELP for help or contact hello@onetakecollective.com.
- Consent to marketing texts is not a condition of using the Platform.
- No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties, except with service providers solely to deliver our messages.
6. Data Storage & Security
- Your data is stored on secure cloud infrastructure located in the United States.
- Passwords are hashed and never stored in plain text.
- We use encryption in transit (HTTPS/TLS) for all data transfers.
- Access to personal data is restricted to authorized personnel, with role-based access controls and audit logging on administrative actions.
- If we learn of a data breach affecting your personal information, we will notify you and the relevant authorities as required by applicable law.
- While we implement industry-standard security measures, no system is 100% secure. You are responsible for keeping your login credentials confidential.
7. AI Features
- Our website chat widget uses an AI assistant. Conversations may be processed by our third-party AI provider to generate responses, are stored on our systems, and may be reviewed by our team or handed off to a human agent.
- We also use AI to help draft internal campaign briefs from information admins provide.
- Please do not submit sensitive personal information (such as government IDs, health, or financial account details) through the chat widget.
- We do not use your personal information to train our own AI models, and our contracts with AI providers restrict their use of your data to providing the service to us.
8. Cookies & Tracking
We use cookies and similar technologies for:
- Authentication: Session cookies to keep you logged in
- Preferences: Theme and display preferences (e.g., dark/light mode)
- Chat sessions: Local storage for chat widget session continuity
- Offline sign-ups: Local storage to queue event sign-ups when a device is offline, until they sync
- Link tracking: Tracked short links in our SMS and email messages record clicks (IP address, user-agent, referrer) for campaign analytics and bot filtering
We do not use third-party advertising cookies or cross-site tracking, so there is no advertising tracking to opt out of via browser signals; because we do not sell or share personal information for cross-context behavioral advertising, Global Privacy Control signals do not change how we process your data. You can disable cookies in your browser settings, but this may affect Platform functionality (such as staying logged in).
9. Data Retention
- Active accounts: We retain your information for as long as your account is active.
- Deleted accounts: Upon account deletion, personal information is removed or de-identified within 30 days, except as noted below.
- Submitted content: Content previously submitted and approved for campaigns may be retained and used per the content license in our Terms of Service.
- Chat conversations: Chat widget conversations are retained for up to 12 months for customer support purposes.
- Opt-out records: We retain SMS and email opt-out records as long as needed to honor your preferences.
- Legal obligations: We may retain certain information as required by law (e.g., payment and tax records, typically up to 7 years).
10. Your Rights & Choices
Depending on your location, you may have the right to:
- Access / Know: Request a copy of the personal information we hold about you and information about how it is used and shared
- Correction: Update or correct inaccurate information (much of your profile can be edited directly in your account settings)
- Deletion: Request deletion of your account and personal information
- Portability: Request your data in a portable format
- Marketing opt-out: Unsubscribe from marketing emails via the link in any message, and opt out of texts by replying STOP

We will verify your request using your account email and respond within the time required by applicable law (generally within 30–45 days). We will not discriminate against you for exercising your rights. You may use an authorized agent where permitted by law, and if we decline a request you may appeal by replying to our decision.
11. U.S. State Privacy Rights
If you live in California or another state with a comprehensive privacy law (such as Colorado, Connecticut, Texas, Utah, or Virginia), you have the rights described in Section 10 under those laws. For California residents (CCPA/CPRA): in the last 12 months we collected the categories of personal information described in Section 2 (identifiers; customer records; commercial information; internet activity; audio/visual content you submit; professional information; and inferences for campaign matching), for the purposes in Section 3, and disclosed them for business purposes to the recipients in Section 4. We do not sell personal information and do not share it for cross-context behavioral advertising, and we do not use or disclose sensitive personal information for purposes requiring a right to limit. We do not knowingly collect or sell the personal information of consumers under 16.
12. Children's Privacy
The Platform is not intended for anyone under 18 years of age, and campaigns involving regulated products are restricted to users 21 and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from someone under 18, we will delete it promptly. 13. Users Outside the United States
The Platform is operated from the United States and intended for U.S. users. If you access it from outside the U.S., you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your jurisdiction.
14. Changes to This Policy
We may update this Privacy Policy periodically. We will post the updated version with a new "Last updated" date and notify registered users of material changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance.
